  • This Privacy Notice (the “Privacy Notice”) governs the processing of personal data by SGS. The Privacy Notice does not cover any third-party websites, applications, software, products, or services that integrate with SGS.
  • Here SGS is acting as a data organizer and data processor: We may act either as a data organizer or a data processor. Our act depends on the specific situation in which personal data is handled by us, as explained in detail below:
    • When we are data controllers, we determine the purposes and means of the processing of personal data. Hence, we are the organizer when you send us an inquiry or sign a service, supplier contract, or employment contract with us. Situations when we are controllers of personal data are further explained in this document. We comply with the data organizer’s obligations outlined in the applicable laws.
    • We are data processors, when we process personal data on behalf of the organizer, for example regarding providing service. As a processor, we process your data only following the instructions issued by the respective data organizer. Such instructions can be seen in our service agreement with customers.

All e-mail statements sent by SGS, including any attachments, may contain privileged and confidential information for the sole use of the intended recipient(s).     • Our third-party vendors, OEMs, who provide us with cloud-based IT and business support, as well as customer care services, may need to process your information. All such third parties are operating under contract and acting on behalf of us.

When our digital marketing activities utilize different third-party advertising platforms' features, we may board you by uploading your account information (e.g., a hashed email address or phone number) or advertising ID to such platform. Such third parties are operating under contract and acting on behalf of us and include data transfers to partners located in the US, UK, EU, and India.

We will only retain your data as long as is necessary for the performance of the contract and as long as required by the provisions laid down by laws and regulations concerning the retention of the data. If we retain your data for purposes other than the performance of a contract, such as accounting and the fulfillment of the mandatory legal requirements, we will retain the data only if it is necessary for that purpose and/or provided for by law and regulations.

Rights and Restrictions

The scope of your rights and restrictions depends on the nature of the process and the legal basis. In order to verify the lawfulness of your request, we may ask you to provide us with an identifying piece of information that allows us to identify you in our system. We will answer your request within a reasonable time frame but no later than 45 days.

Submission of Data

Any data or information material you transmit to SGS through electronic mail, or the Website, or Mobile Applications or otherwise is unsolicited by SGS and is deemed non-confidential and non-proprietary until it is informed specifically to SGS. SGS is not responsible if any user submitted that is abusive, illegal, obscene, pornographic, threatening, disruptive, or otherwise improper. SGS has no liability or responsibility to you for the performance or nonperformance of such activities.

Indemnity

You agree to indemnify, defend, and hold harmless SGS, its officers, directors, employees, vendors, OEMs, suppliers, and agents, from and against all claims, losses, liabilities, costs, and damages of any nature whatsoever, including without limitation legal, accounting, and expert fees, arising out of or in any way connected with your use of SGS Websites and Mobile Applications or personal data you shared or your breach of the terms of this Agreement.
